Immediate Relatives

Immediate relatives of U.S. citizens are eligible to qualify for immigrant visa benefits in the immediate relative category.

Note: Grand parents, aunts, uncles, in-laws and cousins cannot file a petition for a relative for immigration.

  • Spouse or minor child of a U.S. citizen: An immigrant visa may only be processed for a child if he/she has no claim to U.S. citizenship.

  • Parent of a U.S. citizen: U.S. citizen must be 21 or over.

  • Step-parent or child of a U.S. citizen: Step-parent, step child relationship must occur before the child’s 18th birthday.

  • Spouse of a deceased U.S. citizen: Spouse must have been married to the deceased U.S. citizen for at least two years and the petition must be filed within 2 years of the death of the U.S. citizen.

How do I apply?

The U.S. citizen (petitioner) must file an immigrant visa petition, Form I-130, with U.S. Citizenship and Immigration Services (USCIS).  If you reside outside the United States, please visit their website for more information on how to file your petition. Embassy. A separate petition must be filed for each person immigrating. U.S. citizens resident in the United States can file the petition with their local U.S. Citizenship and Immigration Services (USCIS) office.

Note: A petition cannot be filed for a spouse until the marriage ceremony has taken place. The biological child of a U.S. citizen may have claim to U.S. citizenship. A petition cannot be filed until it has been established that the child is not a U.S. citizen.
